It&#8217;s the fear of applying it.<\/span><\/i><\/p><p><b>Imagine<\/b><span style=\"font-weight: 400;\"> this\u2026<\/span><\/p><p><span style=\"font-weight: 400;\">But wait, you <\/span><b>don&#8217;t<\/b><span style=\"font-weight: 400;\"> have to <\/span><b>imagine<\/b><span style=\"font-weight: 400;\"> it.<\/span><\/p><p><span style=\"font-weight: 400;\">This isn&#8217;t fiction. It&#8217;s a <\/span><b>real case<\/b><span style=\"font-weight: 400;\"> that compels us to <\/span><b>contemplate<\/b><span style=\"font-weight: 400;\"> how law, healthcare, and justice intersect.<\/span><\/p><p><span style=\"font-weight: 400;\">A <\/span><b><i>17-year-old rape survivor<\/i><\/b><span style=\"font-weight: 400;\"> walks into a government hospital.<\/span><\/p><p><span style=\"font-weight: 400;\">She&#8217;s over <\/span><b>10 weeks pregnant.<\/b><\/p><p><span style=\"font-weight: 400;\">The doctors know continuing the pregnancy could put her <\/span><b>health at risk.<\/b><\/p><p><span style=\"font-weight: 400;\">Her mother has already <\/span><b>given<\/b><span style=\"font-weight: 400;\"> written <\/span><b>consent<\/b><span style=\"font-weight: 400;\">.<\/span><\/p><p><span style=\"font-weight: 400;\">The <\/span><b>law<\/b> <b>permits<\/b><span style=\"font-weight: 400;\"> the <\/span><b>termination<\/b><span style=\"font-weight: 400;\">.<\/span><\/p><p><span style=\"font-weight: 400;\">Yet&#8230;<\/span><\/p><p><b>NOBODY<\/b><span style=\"font-weight: 400;\"> moves.<\/span><\/p><p><span style=\"font-weight: 400;\">Instead of receiving medical care, she is forced to <\/span><b>approach the High Court.<\/b><\/p><p><span style=\"font-weight: 400;\">The question is\u2014<\/span><\/p><p><i><span style=\"font-weight: 400;\">If the law already allows it, why was the Court even involved?<\/span><\/i><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element Problem\n<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ec9486f elementor-widget elementor-widget-text-editor\" data-id=\"ec9486f\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">India&#8217;s Medical Termination of Pregnancy (MTP) Act already lays down a fairly clear framework.<\/span><\/p><p><b>Up to 20 weeks,<\/b><span style=\"font-weight: 400;\"> the opinion of one registered medical practitioner is generally sufficient.<\/span><\/p><p><span style=\"font-weight: 400;\">Between <\/span><b>20 and 24 weeks,<\/b><span style=\"font-weight: 400;\"> the opinion of two registered medical practitioners is required for specified categories, including survivors of sexual assault.<\/span><\/p><p><span style=\"font-weight: 400;\">For <\/span><b>minors<\/b><span style=\"font-weight: 400;\">, the <\/span><b>consent<\/b><span style=\"font-weight: 400;\"> of the <\/span><b>guardian<\/b><span style=\"font-weight: 400;\"> is required.<\/span><\/p><p><span style=\"font-weight: 400;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<strong>\u00a0\u00a0In this case&#8230;<\/strong><\/span><\/p><p><span style=\"font-weight: 400;\">The survivor was only <\/span><b>10<\/b> <b>weeks pregnant.<\/b><span style=\"font-weight: 400;\"> Legally, this wasn&#8217;t a complicated case.<\/span><\/p><p><span style=\"font-weight: 400;\">So what caused the <\/span><b>delay<\/b><span style=\"font-weight: 400;\">?<\/span><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-e067b53 e-flex elementor-element-8b10085 elementor-widget elementor-widget-text-editor\" data-id=\"8b10085\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Instead of taking a medical decision that the law already empowered them to take, the hospital chose the safer route\u2014<\/span><\/p><p><span style=\"font-weight: 400;\">&#8220;<\/span><b><i>Let&#8217;s wait for the Court.&#8221;<\/i><\/b><\/p><p><span style=\"font-weight: 400;\">The Madhya Pradesh High Court <\/span><b>didn&#8217;t appreciate this approach.<\/b><\/p><p><span style=\"font-weight: 400;\">Justice Vishal Mishra observed that hospitals are increasingly treating <\/span><b>judicial permission<\/b><span style=\"font-weight: 400;\"> as a <\/span><b>routine requirement<\/b><span style=\"font-weight: 400;\">, even when the <\/span><b>law doesn&#8217;t demand it.<\/b><\/p><p><span style=\"font-weight: 400;\">The Court called it what it truly is\u2014<\/span><\/p><p><i><span style=\"font-weight: 400;\">An unnecessary delay in matters where every passing day matters.<\/span><\/i><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-3463a83 e-flex e-con-boxed style=\"font-weight: 400;\">Pregnancy doesn&#8217;t pause while paperwork moves.<\/span><\/p><p><span style=\"font-weight: 400;\">Every day&#8217;s <\/span><b>delay<\/b><span style=\"font-weight: 400;\"> can <\/span><b>increase<\/b><span style=\"font-weight: 400;\"> physical risks, emotional trauma, and <\/span><b>medical complications.<\/b><\/p><p><span style=\"font-weight: 400;\">For a survivor of sexual assault, <\/span><b><i>waiting isn&#8217;t merely inconvenient.<\/i><\/b><\/p><p><span style=\"font-weight: 400;\">It can become another form of <\/span><b>suffering<\/b><span style=\"font-weight: 400;\">.<\/span><\/p><p><span style=\"font-weight: 400;\">Sometimes\u2026\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span><\/p><p><i><span style=\"font-weight: 400;\">It&#8217;s healthcare denied.<\/span><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7763080 elementor-widget elementor-widget-heading\" data-id=\"7763080\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">But Aren't Doctors Protected?<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ab73321 elementor-widget elementor-widget-text-editor\" data-id=\"ab73321\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Interestingly&#8230;<\/span><\/p><p><b><i>Yes<\/i><\/b><span style=\"font-weight: 400;\">.<\/span><\/p><p><span style=\"font-weight: 400;\">The MTP Act itself provides <\/span><b>protection to doctors who act in good faith<\/b><span style=\"font-weight: 400;\"> while performing medical termination under the law.<\/span><\/p><p><span style=\"font-weight: 400;\">The <\/span><b>legislation<\/b><span style=\"font-weight: 400;\"> was designed to <\/span><b>empower medical professionals, <\/b><span style=\"font-weight: 400;\">not make them fear every decision.<\/span><\/p><p><span style=\"font-weight: 400;\">Yet, <\/span><b>institutional hesitation often replaces statutory confidence.<\/b><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3940a13 elementor-widget elementor-widget-heading\" data-id=\"3940a13\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Beyond Law... It's About Dignity<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-db3eaab elementor-widget elementor-widget-text-editor\" data-id=\"db3eaab\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">This debate is much bigger than gestational limits.<\/span><\/p><ul><li><span style=\"font-weight: 400;\">It&#8217;s about <\/span><b>bodily autonomy.<\/b><\/li><li><span style=\"font-weight: 400;\">It&#8217;s about <\/span><b>dignity<\/b><span style=\"font-weight: 400;\">.<\/span><\/li><li><span style=\"font-weight: 400;\">It&#8217;s about whether a rape survivor should spend her time recovering\u2014<\/span><\/li><li><span style=\"font-weight: 400;\">Or proving that she deserves healthcare already guaranteed by law.<\/span><\/li><li><span style=\"font-weight: 400;\">The <\/span><b>Supreme Court<\/b><span style=\"font-weight: 400;\"> has repeatedly recognised <\/span><b>reproductive choice<\/b><span style=\"font-weight: 400;\"> as an integral part of the <\/span><b>right to life, privacy and dignity under Article 21<\/b><span style=\"font-weight: 400;\"> of the Constitution.<\/span><\/li><\/ul>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7099aec elementor-widget elementor-widget-heading\" data-id=\"7099aec\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div
